County moves 10C monument, but retains ownership?
I'm involved in a lawsuit against my county over a 10C (Ten Commandments) monument at the courthouse.
The county plans to move the monument to private property but retain ownership (waiting for Bush to appoint 2 more Supreme Court Justices, of course.) Does anyone know if my county's plan has been followed anywhere else? I'm uneasy about the potential for continuing mischief by the county, but I'm not sure there is a constitutional objection. |

I'm not sure what your objection is. Would the county ordinarily have to sell the monument, or destroy it perhaps? What would prevent them from creating another one in the event that the SCOTUS has a fundamentalist meltdown?

From the information provided, I do not think that this would be sufficient.
Imagine a city council buying religious artwork, retaining ownership, but transferring it to "private property" (e.g., a local cathedral). This is not violating church and state? Hardly. |
