The Boy Scouts are not really private, because they are given access to government facilities for their events and they are allowed to recruit in public schools. They are a discriminatory organization - it seems a lot like allowing the KKK to recruit at public schools.

Yes, it is US Code, Title 36, Subtitle II, Part B, Chapter 309.
