Case law: Government preferences for religious discrimination
I'm wondering if anyone can point me to some case law on the issue of government giving preferences to organizations that discriminate on the basis of religion.
The Boy Scouts discriminate on the basis of religion. They bar anyone from membership who does not believe in a supreme/supernatural being. It seems to me that it would be unconstitutional for the government to give special preferences to the BSA based both on the 1st Amendment establishment clause and on the 14th amendement equal protections clause. I'd like to know if anyone knows of any case law to support that claim. |
