The text of yet another court case which Dr. Dino has lost. It is very revealing. Don't forget to read the footnotes!

Incedentally, what does the "with prejudice" actually mean? I'm thinking it means something of the sort of, "and you're a dumb-ass for even bringing it up," but I doubt any legal dictionary contains that wording.

A dismissal without prejudice permits the plaintiff to sue again on the same causes of action, while a dismissal with prejudice bars the right to bring or maintain an action on the same claim or cause. Does that help?

IANAL, but I believe it means that you cannot bring the issue back to court, even if you have additional evidence. "Without prejudice" would mean that the current case is dismissed, but Hovind could regather evidence and present it again. Judge must have known that Hovind would never actually look at evidence.

I don't think "dumb-ass" would really fit it. I think that the court is basically saying that Hovind is knowing misusing the court. The court should not express prejuce against someone who honestly, but mistakenly thought they had a case but mere rule against them.

But then again I am NOT a lawyer. Treat what I write with a few shovelfuls of salt.

Just looked it up. It means that the motion to dismiss is interpretted as being the final judgement of the case. "Without prejudice" means that the court has made no decision on the matter, and the plaintiff reserves the right to reintroduce it at a later date.
