Post a ruling on the constitutionality of the pledge

Hadn't heard about it yet. However:

"It was not until 1942 that Congress officially recognized the Pledge of Allegiance. One year later, in June 1943, the Supreme Court ruled that school children could not be forced to recite it. "

"Under God" was not added until 1954. I suspect that the "under god" statement is the part their ruling would reflect on.

Yep... it's apparently true. CNN just announced it and will be talking about it on their "TalkBack Live" program shortly...

You can be sure the fundies will have their panties in a twist over this one!!!

It'll be appealed alright, and immediately unless the losers think they can get a better result by requesting that the 9th Circuit reconsider the decision en banc. Any bets on whether Diana, Mary and Flo will take the case?

I would disagree with the statement the link in the OP post makes - "...and cannot be recited in schools." I would assume that under the ruling, the pledge with "under god" can be recited in schools by students if they so wish (I would hope their right to freedom of speech would prevail) - just not as a school-sponsored or required pledge.

Summary: The addition of the words "under God" in the Pledge of Allegiance to the Flag (via 1954 federal statute), and a school district policy of teacher-led daily recitation of the Pledge, with the added words included, violate the First Amendment's Establishment Clause.

Newdow was a pro se litigant - it doesn't look like he even had the ACLU or AU or FFRF on his side.
