Post 1st Amendment: Bad idea

I sometimes wonder if the 1st amendment restrictions on an establishment of religion were ultimately such a good idea.

Because I so very often find the defenders of freedom distracted by questions of what the founding fathers meant, instead of discussing why the Pledge law (among others) are bad law.

Because I find that an excess of energy is spent in the courts of law rather than in the courts of public opinion, and as such the public has lost the concept of freedom. A loss that will, eventually, work its way into the courts.

I offer this as a point of discussion. Do not take this as a serious proposal. Mostly caused by a frustration over too many debates getting sidetracked into a meaningless question of whether Madison or Jefferson would have allowed 'under God' in the Pledge of Allegiance.

While my point is: If they had wanted it in there, then they would have been wrong too, just as they were wrong about slavery, and all Men being created equal to each other, but superior to women.
