I think Moral Foundations and Principles is where this belongs, although Political may also be a fit. At any rate, I did not already see a thread on this (not that I check MF&P often), so here is a news story I found:

I see it as a MF&P issue due to the moral implications of the death penalty. Even in what has seemed a cut and dried case (and may well be), evidence that may have been important was not acted on. Given one of the questions of morality and the death penalty, not acting on possible evidence raises questions is the death penalty, as enforced, is a moral system.
