Default Religious anti-gay bias exemption to Civil Righs Laws?

Lesbian Sues Over Physician's Refusal to Do Insemination (requires free registration)

Quote:
Eager to start a family, Lupita Benitez asked her doctor to help her conceive a child through artificial insemination. Benitez thought her request was routine -- just another of many from women who face infertility and seek medical help to get pregnant.

But Benitez's doctor, Christine Z. Brody, refused to perform the procedure. Her reason: Benitez is a lesbian, and Brody said it was against her Christian beliefs to help a homosexual become pregnant.
[California has a civil rights act that prohibits discrimination in public services on the basis of sexual orientation.]

Feh.

Well, presuming that the doctor in question is a private practicioner, I would suggest the lesbian in question seek medical care elsewhere.

HOWEVER.

If that doctor is working for a government entity (state, county, or city run clinic or hospital), that behavior is inexcusable.

The doctor was the only one the lesbian could see in her medical plan. She did seek care elsewhere, for which she had to pay extra, although her HMO eventually refunded that to her. But the doctor was still violating California state law by refusing her medical treatment because of her sexual orientation.

Ah I see.

In that case, I think they should rake this doctor across the coals.

I can't help wondering if this will be a new plot-thread on "E.R."
