Angry Mercer County KY 10C monument - the ACLJ wins at Federal Court level

Oh, shit.

Business Wire news about 10C at Mercer County KY

I don't know if that link will be available forever.

The Federal Court judge (Karl Forester) who was hearing the ACLU challenge to a 10C monument in Mercer County granted the ACLJ motion for summary judgement, dismissing the suit.

I assume the ACLU will appeal.

Aargh. According to the ACLJ's mission statement:

"The American Center for Law and Justice is a public interest law firm committed to insuring the ongoing viability of constitutional freedoms in accordance with principles of justice as outlined in Scripture.
...
The American Center has a national network of attorneys who are committed to the defense of Judeo-Christian values."

They're sure as hell not acting in my interests, nor of the interests of a sizable portion of the U.S. population.

They should really change their name to reflect more accurately what they really are... say to ACLJALAYC.

Here's Jay $ekulow's write-up on the ruling. From the article:

In the opinion, Judge Forester said “the display clearly has a legitimate secular purpose of, including but not limited to, acknowledging the historical influence of the Commandments on the development of this country’s laws, and the record is devoid of any evidence indicating a religious purpose by the government.” The court also concluded “the primary purpose or effect of the display is not to endorse religion as a matter of law.”

Sooooo...anybody can put up a "monument" on government property as long as it has some historical reference/meaning, they pay for it and arrange to do it in the middle of the night?

Not without gettin' sued by the good 'ole ACLJ watching out for the public interest, if the monument didn't express Judeo-Christian values.

So, signs that say first and foremost "You shall have no gods but me," don't have a religious meaning... as long as James D. Kennedy didn't pay for them?

Well, I figure turnabout is fair play. Does anyone know of a Bible verse that condones setting religious monuments on fire and throwing them through people's windows?

Summary judgement, my ass. It is certainly not obvious that the state had no religious purpose for displaying a purely religious text.

My prediction: reversed and remanded

Not a big deal, there are about four other cases just like this one going on in KY. One of them is going to set the obvious precident that despite the false witnessing of "christians," the 10c's is not a secular document and they are not being displayed for secular reasons.
