Thumbs down Sutton Confirmed

Today the Senate confirmed Jeffrey Sutton to a seat on the U.S. Court of Appeals for the Sixth Circuit. The vote was 52-41. Two Democrats -- Feinstein of California and Nelson of Nebraska -- jumped ship and voted for confirmation, while seven senators didn't vote at all. You'll find the roll call here.

Sutton is exactly the sort of nominee that we're all too used to seeing from the current administration. Naturally, he's a big gun in the Federalist Society, and since 1998 he's been a partner in the Cleveland-based megafirm Jones, Day, Reavis & Pogue, known without the slightest hint of affection as "Jones Day & Night" to the firm's junior associates. NYTimes editorial against Sutton

Why the Dems didn't filibuster

It appears that Diane Feinstein voted for him, which means that she probably got some assurance that he would not vote to overturn Roe v. Wade.
