Default Laci Peterson case

Should it be considered a double murder?

No. Tragic and idiotically criminal yes. But double murder? Of course not.

They found two bodies. Why not a double murder?

For the California law on this, see my post here: http://www.iidb.org/vbb/showthread.p...5&pagenumber=3

I don't really have a problem with the law as applied to this case, since Connor was pretty much full term and capable of living outside his mother's body.

I'm pro-choice in general. While I'm still not sure exactly how I'd like the laws to treat this issue, I personally believe that a first trimester embryo/fetus should not be treated as a person, while a viable fetus deserves some sort of recognition. I also don't have a problem with the pregnancy of the victim (even if it's only four weeks along) being an aggravating circumstance in a murder case.

Then why are late term abortions legal or, even when not legal, not considered murder?
There should be the same legal standard applied. If Scott Peterson can be charged with murder then a woman getting an abortion at such late a stage should be treated the same.

Why?

I personally believe this whole double-homicide thing is a way to further slant the case. Whenever a child is involved, the emotional level gets turned way up.

If you chopped your own finger off, should that be considered assault and battery just as if someone else chopped your finger off against your will?

Yet a child, even an unborn one, is not the same as a finger. An unborn child is in the woman's body but is not the part of it. For a murder charge a victim has to be a living human being. So if a late term fetus is a living human being it should be considered such no matter who decides to kill it.

Would you advocate infanticide as well (but only when the mother does it)?

And why is he facing the death penalty when that woman in Texas that killed her husband with a Mercedes got only 20 years. Isn't Texas supposed to be the state with thye most death penalties?
