At this point I'm almost hoping that both Rehnquist and O'Connor decide to bail. That way we'll likely have three clusterfuck confirmation fights on our hands, one over elevating Scalia to CJ and the other two over new associate justices. Bush and his handlers are pretty much completely convinced of their own invincibility at this point and they'll never be able to resist the urge to go way over the top with their nominations.

My biggest fear is that Bush and his handlers are exactly right. I can really envision Dubya putting two Scalia Jrs. on the Court and getting elected anyway. The American public has just been far too scared and stupid since 9/11.

I think the American public has recovered quite a bit. There are a few vocal talkradio addicts that perpetuate the illusion that America is still running scared, but I think the bulk of the voting public will go back to the old Party Games.
