Yes, if a school's policy is "open" than they can't prevent groups like the KKK from using it too. The problem in instances like this is that the school system lacks any comprehensive policy. It then comes back to bite them on the butt when someone "else" wants to distribute materials to school children. They're free to change the policy (within legal standards), but it can't be retroactive. One of the major problems is also that schools are allowing non-student initiated clubs to meet right after school in elementary and middle-schools. This is how the Good News Club gets in. A reasonable policy in my view, would be to only allow academic-oriented programs (and perhaps sports teams) to meet in schools from the time classes are over to say 6:00 pm, and allow only those programs to send flyers home. Religious groups and other non-academic programs can still use the facilities they just have to wait until after 6:00.

Yes, but they're not blatantly evangelical groups. At least they weren't when I was a member of those organizations. This probably doesn't make for any legal distinction, but there's certainly an ethical issue here as pertains to the Justice Department's support. Their claim that the Good News Club is primarily a recreational outfit that has a religious viewpoint is blatantly false. The GNC is primarily an evangelical outfit whose purpose is to make converts out of impressionable children; that they may provide some modicum of recreation just to keep the kids awake doesn't change their primary mission. Unlike BS or YMCA, which provide ample outdoor activities, the GNC is totally devoid of secular value.

The Girl Scouts aren't Christian, though we do have a part about doing our best to "serve God, and my country" in the pledge. But there is no evangelism or Bible reading of any kind going on in official functions and meetings. In fact, you can opt out of the serve God part if you want. As an atheist since birth and a Girl Scout, I have no problem with them in schools.

But as for the rest of them, sue away, I say! Christian groups have no business evangelizing in public schools.
