Well, it's debatable. Was this done by Unfaith? Then it could be construed as mostly a publicity stunt in order to make money off of Metallica's reputation. It's entirely possible that the parody would be considered a trivial aspect of commercial speach. Remember that commercial speach has quite a few more restrictions than private speach. That would let it fall under trademark infringement. |
