The Supreme Court, in a case that reaches to the core of American values, heard argument Wednesday on whether Texas or any other state can ban private homosexual conduct between consenting adults. A gay couple -- charged with violating the sodomy ban after police entered a Houston area home and found them having sex -- is challenging the Texas ban Can this really be true? I guess i've heard of places that ban anal sex, but i had always assumed it was one of those ancient laws that are still on the books but not enforced.

Sadly it is real.
I wonder if they would have charged them had it been a man and women rather then two men. Not likely. |

I'm surprised the Sup Ct is hearing this case. I thought the Bowers opinion was pretty clear that the 14th Amendment does not protect anal sex, and the Court hasn't exactly gotten more liberal since then. Maybe the Court just wants to remind gays that it still hates them.
The good news is that the *Georgia* Supreme Court ended up throwing out Georgia's old sodomy law on *state* constitutional grounds, even after the law was upheld in Bowers. Maybe the best opportunity is to work through the state courts. Well, unless you're in Texas. |

Oral sex is also illegal in texas I believe.
