The Sixth Circuit Court of Appeals has upheld (2-1) the lower court's decision that the Ten Commandment monuments in front of the schools in Adams County, Ohio are unconstitutional.

It's been a good week for the Constitution.


(Re-reading the story, it appears that this is not a final decision on the merits of the case. It seems to be a ruling that the 10C must be moved while the case is being decided. Still, a promising sign.)

Yes, it's an encouraging sign and a pleasant surprise! The 6th Circuit is generally inclined to grant stays in cases like this, but the school district's shenanigans were apparently enough to put off two of the three judges who decided the motion. <a href="http://pacer.ca6.uscourts.gov/cgi-bin/getopn.pl?OPINION=02a0399p.06" target="_blank">The opinions</a> make for interesting reading, both the black-and-white part and the stuff between the lines.
