Default Court to hear "enemy combatant" appeal

CNN article

From the article:
Quote:
The Justice Department has been fighting attempts by lawyers representing Padilla to meet with him to discuss his case, arguing that could jeopardize national security.
Quote:
The courts should have no role in reviewing these designations, Bush administration lawyers have argued, because they are inherently military decisions, which the executive branch is uniquely qualified -- and empowered by the Constitution -- to make.
I find this whole thing very, very scary. I don't understand how so many people are un-concerned about this... a lot of people I've talked to about it have been totally oblivious to the fact that Padilla is a U.S. citizen - born in Brooklyn, N.Y. - and has been in the military "brig" for OVER A YEAR with no charges filed.

Your thoughts?

As near as I can tell, Bush can declare someone as an "enemy combatant" and the charged person effectively disappears.

No questions asked. No trial. No charges made. Nothing.

My thoughts? Why don't they just skip the charade and simply give the Administration the right to execute anyone they like, right on the spot.

I might even respect them for it.

It's the same kind of thinking that led us into an Iraq war. Just as we invaded first, then looked for evidence later. They've locked up Padilla and are now looking for evidence to charge him.

Already happened:

U.S. missile strike kills al Qaeda chief

Note in the first paragraph (emphasis mine):

Quote:
In a CNN interview, a top Pentagon official called a missile strike that killed six suspected al Qaeda members in Yemen "a very successful tactical operation" and said the U.S. must "keep the pressure on" terrorists wherever they are.

I find it ironic. Through the dark years of racist, fundamendalist apartheid the US was a beacon of hope here in South Africa, a symbol of how things could be done right.

Now we're getting government funded 5 page supplements in popular dailies about safe gay sex and you lot are having your constitution torn to shreds.

I sincerely hope that you manage to depose GW in the next elections. Its terrible to see a great nation trampling on all that it stands for.

I'll most likely be in South Africa at the next Presidential changeover. If it is Bush again, maybe I'll just stay there for another four years.

M'sorry, what does gay sex have to do with any of this?

He's using the example to show how much South Africa has changed, especially in relation to the US. During the apartheid South Africa looks towards the US as what life should be like, now South Africa is much more liberal (illustrated by the government funded inserts on safe gay sex) and the US constitution is being torn to shreds.q

Exactly. While one nation opens its mind, another closes same. Apartheid was not only racist, it was calvinist. Censorship exceeded that of some Islamic countries with regard to sex. Now the US (or at least its administration) is dominated by blinkered warmongering fundamentalists,

I'm not saying protection of legal rights (Padilla) is directly linked to gay sex, just illustrating a zeitgeist if you like.

You sound disaffected. In fact, your talk could be considered treasonous.

Please turn yourself in to your local Ashcroft facility for re-education.

Thank you.
