The US government routinely deports naturalized citizens who have served time to their countries of origin; this was even before Patriot I. Now we hear that the government could (theoretically) put me in front of a military tribunal for jaywalking and ship me to Guantanomo. This was affirmed by the supreme court as usual on a 5-4 margin which also stated that the congress can makeup any law regarding aliens without being concerned too much about human rights(sic). The justification for the deportation of naturalized citizens with criminal records is this: in order to begin the citizenship process (if not get an entry visa) you have to affirm that you have no criminal record, or to voluntarily fess up to what the artist formerly known as the INS will find when they do a background check. If there's truly something heinous on your record, they'll ship you back without even bothering to say hi.
These citizens who got deported before did so because their citizenship was granted in bad faith: they lied (however inoffensively) about having criminal records abroad. Because the immigrants acted in bad faith, the government has no obligation to honor their citizenships, except in name where peoples' prior citizenships were terminated by being naturalized here. As for the post-PATRIOT Act stuff... that shit scares me as much as it scares you. |
