I think one waring is enough. If they do not listen the first time, why would they a second or third?

Indeed. Well my point in no longer worth mooting, in a sense, because EasternGate did not "take the hint" and has become bann'd.

The last thing this site needs is a "if you receive this number of warnings, you are automatically banned" policy. We all know the damage it has done at CF.

I try to be kind to people in general but I don't respect the mindset of a person who thinks himself/herself above the rules of a board, who deliberately breaks rules even after being warned - so clearly, it is not an oversight on their part. And this is exactly the reason that the Administrators here agonize over each and every single ban decision. It takes a pretty good record of disobedience, or else a proclamation that rules are to be ignored, before we will consider banning somebody.

But the fact that each decision is agnoized over allows us to adjust the result to each individual rather than adopting a "one size fits all" sort of a standard. In a way, this is more ethical, because it allows us to tailor the punishment to fit the crime.

Just for the record, I have NO problem with EasternGate getting banned.

Sometimes people will not behave.

Rule number 5 seems to be a clarification of the part of rule number 2 in regards to copyright law where it is stated that one agrees to not do things that are illegal. So, in any case those that are banned due to plagarism have not only been warned once, but twice in the rules.

Perhaps the addition of a link to the rules (perhaps, "by posting here you agree to the rules") at the top of the front page of the forum would facilitate reading of the rules. I notice that they are a little bit hidden. You can only find them in this forum, and they are the sixth thread. The addition of some stars or exclamation points to any links might make said links even more important looking.
