A lot of people said that about the bill of rights. That it was not needed, because "Why do you need a constitutional amendment to get the government to do something they should be doing anyway?"

However, the amendment under discussion here is not one to 'get the government to do what it should be doing.' It is an amendment to get the government to do what it SHOULD NOT be doing.
