The problem here is that the line is blurred with younger children.

Its one thing to have religious group meet after school.
Its another when the teacher is handing out the flyers to young children who do not know the difference. They see the teacher as an authority figure. Many have not developed the capability of distinguishing the teacher acting on her own behalf without support of the school and her acting on her own.

Essentially the Good News Club is using the teacher's position to promote itself directly to a captive audience.

If the Good News Club rents the facilities after school, this does not imply that they get promotional time or access to the school at other times.

I don't think the establishment cause applies to an open, public forum. A group that memorizes Scripture should not be treated differently from a group that memorizes Shakespeare, nor a group that sings hymns differently from one that sings pop songs.

The thing is, the Good News Club is not the only organization given the opportunity to have this captive audience (at least, I don't think so). Such a flyer program is probably a bad idea, but if it exists, any organization that qualifies should be able to utilize it.

Well, YMCA and Scouts are kinda "undercover" religious, while the flyer mentioned in the OP was explicitly religious... and, also to say that religious organizations already have that kind of access in the public school system my child attends. Yeah, that's the ticket.
