Default California Pledge Case?

Remember the case (I believe it was in california) where an etheist sued the school board ove the pledge of allegeince and it caused a big uproar?

Well whatever happened to that? The last thing I heard was that it was allowed to proceed and that was right as it was becoming not news anymore.
