Poor Jerry Melvin. The Constitution doesn't say, "Congress shall not make an establishment of religion." It says, "Congress shall make no law respecting an establishment of religion."

Jerry is in the Rehnquist camp, among those so-called nonpreferentialists that seem to believe the phrase "no law" somehow allows Congress to pass "some laws." This was the gist of Rehnquist's argument in Wallace v. Jaffree, upon which the Pulitzer Prize-winning historian Leonard W. Levy commented, "Rehnquist wrote fiction and passed it off as history."

In the meantime Jerry is free to get some exercise wallpapering his basement with the book of Deuteronomy.

Ker-rist. That kid who rammed that light aircraft into that building in Florida a few months back could have saved us all a lot of hassle by picking a better target.

(Note to self: add Florida to states not to visit, along with Alabama.
Second note to self: save hassle and avoid all former Confederate states?)
