Actually the commandment may be better rendered as "do not kidnap". I'll try to find sources for this translation.

Thanks, that does seem to make the new proposal more plausible, at least.

Mechilta Nezikim 5
Snahedrin 86a
Maimonides, Yad, Hilch Gevenah 9:1

The capital offense in question is Exodus 21:16 He who kidnaps a man--whether he has sold him or is still holding him--shall be put to death.

Old Testament law was never part of the Christian obligation (Old Covenant vs. New Covenant) until Protestants came along and threw out the context in which the church always understood the various parts of the bible and screwed it all up.
