DeLay Continues Attacks on Federal Courts

The framers never intended for there to be the INTERNETS, much less for judges to use it for *gasp* research! What is Justice Kennedy thinking? He doesn't need to do research. He just needs to pray, and God will tell him what to write. :banghead:

Yes, I have informed the lawyers at my firm that their daily research activities on behalf of clients are, in fact, outrageous. They had not previously been aware of that.

Presumably Delay is either assuming or is expecting his audience to assume that Kennedy is browsing the Nation web-boards and IIDB for policy advice, and either he is unaware or he is expecting his audience to be unaware that, most likely, every federal judicial opinion today is researched on the internet, using lexis.com or westlaw.com. Some judges may be creaky enough to demand paper reporters, but I doubt their clerks are going to be wasting their time manually Shepardizing things.

Honestly, as a lawyer, the surprising thing to me in that quote is not the Internet; it's the claim that Kennedy does his own research. In the lower federal courts, most opinions are not just researched but written by the judge's just-out-of-law-school clerks, and I've always assumed that Sup. Ct. opinions are, if not actually written, at least researched and drafted by the Supreme Court clerks.

A Supreme Court justice using the internet?! Horrible!

They're supposed to sit there and rubber-stamp what the conservatives want. Thinking is prohibited!

I wish the Dems controlled the Senate. Then they could pass a special bill amending Medicare/Medicaid. It would affect only one person, much like the Schiavo bill. It would provide for Tom DeLay's mental health care, even though he isn't poor enough to qualify for Medicaid nor old enough to qualify for Medicare.

I think it's kind of odd, too. I have attorneys I have to stand behind and give click-by-click instructions to reply to e-mails. They don't call it research unless it involves hefting enough books to give you a hernia, and yes, they manually Shepardize. So if Kennedy is really doing internet research, good on him.
