So do we continue to allow religious extremists to walk all over us, as they have always done, without any attempt at self-defence and reclaiming our institutions from them? Do we have to agree that all human efforts, poetry, music altruism etc, are on account of Jesus or his Dad robotically controlling us like puppets? Now for the first time this court case makes it possible to throw off the shackles of Christianity, and you want to throw it away? Those who still want it will still be free to practice it whatever the outcome.

I agree it would be interesting, and as I said it will fuel the flames of the RR. Of course they love it. I can see Pat Robertson now - praying for god to strike a thunderbolt at the Italian courts and destroy their secular humanist institutions. The problem is that the money will just pour in to their coffers over this. Can you imagine Jerry Falwell's donation requests over this? I bet $$50 the dickwad will leave out that the court fight took place in Italy, thus implying that it was here in the U.S! Sheesh.

I think it will help to focus attention on these charlatans, and then they can also be sued in their turn, for massive fraud and extortion of public funds.

)ver herewe could get all of our best minds meaning those who have studied the most and challange the best xtion scholars to a debate on 60 min. Or any popular news show.on the existence of christ.Now that would be something to see.Some one on the forum told me we wennt ready for this yet.

And you do not have the story correct either. Note that they both attended the seminary for the priesthood together. They live in the same town. One became a priest, the other became an atheist. The atheist wrote a book on the paucity of evidence for the Jesus of the Gospels and maintained that some of the stories were mixed up from another person who was killed. The priest basically told his parishioners to not only ignore the book, but more or less told them to shun the writer because he was from the devil.

Many countries in Europe have laws unllike the US that protects the buyer from snakeoil salesmen. Basically the writer is saying that the priest is selling his parishioners a bunch of lies, and that is illegal in Italy.

No this lawsuit is crazy. He has little chance of winning. The preist is not purposely lying . He believes that Jesus exists. The planiff should have chaalged the priest to an debate in an neutral setting. This case will have no effect on christianity in italy. It will be here long after we are dead

Well does that imply that the priest knowingly lied to his parishioners. The priest belives that Jesus exists. Those laws protect people from con artists. people who knowingly set out to deceive their victems. I think the preist will win the case.

Finalmente ci siamo. Dopo quattro anni spesi tra querele, esposti,
archiviazioni e ricusazioni, il 27 gennaio alle 9 don Enrico Righi, parroco
della chiesa di San Bonaventura a Bagnoregio, cittadina in provincia di
Viterbo, comparirê di fronte al giudice per le udienze preliminari, Gaetano
Mautone, per rispondere dei reati di abuso della credulitê popolare e
sostituzione di persona. Il prelato, reo d'aver diffuso un bollettino
parrocchiale nel quale sosteneva la veridicitê storica della figura di Gesù
Cristo, al magistrato dovrê dimostrare l'infondatezza delle accuse che gli
vengono mosse. Cristo esiste? O meglio: è mai esistito? L'insolito
verdetto, tra un mese, spetterê al gup del tribunale di Viterbo. Inutile
dire che la questione, oggetto di secolari dispute teologiche, ha poco di
giuridico. Se non fosse stato per la pervicacia di un ateo convinto, Luigi
Cascioli, agronomo in pensione, che il 13 settembre 2002 ha presentato una
querela alla procura della repubblica contro l'ex compagno di seminario don
Enrico Righi. Sostenendo che dire, o scrivere, come il prelato ha fatto,
che Gesù, figlio di Giuseppe e Maria, nato a Betlemme e cresciuto a
Nazareth, è acquisizione storicamente determinata, integra gli estremi del
reato. Abuso della credulitê popolare, in primis. Quindi, se Gesù Cristo è
un falso storico, chi ne sostiene l'esistenza commette reato, traendo in
inganno i fedeli. Di più: tutti i ministri della Chiesa, e non soltanto il
curato di Bagnoregio, sono colpevoli. «Del resto - aggiunge Cascioli - tale
impostura assicura loro un consistente vantaggio patrimoniale derivante
dalle offerte, tra le quali l'8 per mille alla Chiesa cattolica». Quanto
alla sostituzione di persona è presto detto: la figura di Gesù è stata
mutuata da quella di un personaggio leggendario dell'epoca, Giovanni di
Gamala, figlio di Giuda. La procura di Viterbo, che sulla questione non
vuol perdere tempo, archivia la notizia di reato come «palesemente
infondata» e, ritenendo indelicato coinvolgere il parroco in procedimenti
giudiziari, la rubrica contro ignoti. Cascioli si oppone. Scrive al
Consiglio superiore della magistratura: don Righi sia iscritto nel registro
degli indagati, come la legge impone in caso di denunce nominative.
Interviene il tribunale di Perugia, competente su Viterbo, e il parroco di
Bagnoregio riceve due avvisi di garanzia. Si fissa una nuova udienza
preliminare e il pm Petroselli per la seconda volta chiede che il
procedimento sia archiviato. Cascioli ricusa il giudice, la questione
finisce alla quarta sezione penale della corte d'Appello di Roma.
Ricusazione respinta e «stante la temerarietê del querelante» condanna a
1500 euro di ammenda. È il 26 maggio 2005. Cascioli non si dê per vinto e
scrive una lettera aperta a don Righi, dichiarandosi disposto a ritirare la
denuncia a patto che il curato porti una prova dell'esistenza storica di
Gesù. Poi invia una seconda lettera al cardinale Biffi che, quale profondo
conoscitore dei testi sacri, potrebbe dirimere la questione. Intanto la
giustizia fa il suo corso: il tribunale di Viterbo fissa la data per
l'udienza preliminare a carico del parroco. Ma la cancelleria sbaglia, sul
decreto notificato alle parti compare l'anno 2005 e non il 2006 come
sarebbe dovuto essere. Una svista che ha rischiato di allontanare l'epilogo
del processo a Gesù. Duemilasei anni dopo.

Basically, if my Italian is correct, on the 27th january 2006 there will be a trial to judge the priest. He must
demonstrate that Jesus really existed.
He's accused by Mr Cascioli of cheating people. The church is also accused of
gaining money from religious believers by exploiting Jesus' existence.

The second half of the article relates how the case started and how
the court in the first instance refused to judge it. Mr Cascioli was also made
to pay 1500 euros because of his initial persistence.
At the end the date of the trial was decided.
