(1) Because their publication is securely dated to the mid fourth century, and thus after the Nicaean implementation of the Constantinian version of the State Christian Orthodox Church of 325 CE
But the Nicean Creed says nothing about scripture ...

Not to mention that their "publication" can only be securely dated to the mid fourth century or before, perhaps before or after Constantine.

See the Extracts from the Codex Theodosianus (313 to 453 CE) such as the legislation c.326 CE "Religious privileges are reserved for Christians."

The publication date of the NHC has been estimated to the mid fourth century at least by the examination of the cartonage of the codices. That is, the bits of paper used on the covers have been exmined with great scrutiny and securely dated fragments are ascertainable dated to the mid 4th century. So the series of codices that comprise the Nag Hammadi set must have been physically assembled and published in the mid 4th century. Somewhere I think I read that the spine of the codex containing the gThomas at Nag Hammadi was C14 dated to 348 CE, but I dont seem to be able to refind that source.
