Even if it is a picture of the Emperor it is a symbolic representation of the Emperor not an attempt at a photograph.
It might be argued that to the people of antiquity the technology of a skillfully created mosaic (which survived, or paintings that did not) was equivalent to the technology of a 21st century photograph. What better way was there to declare openly your devotion and piety towards the very powerful ruler of the age, the Lord God Caesar Constantine?
